Terms and Conditions

  1. Definitions

In these terms and conditions, unless the context otherwise requires, the following definitions shall apply:

"Ox Roofing" refers to Ox Roofing Ltd. 

"Client" means any person or entity that purchases goods or services from the Company. 

"Contract" means any agreement between the Company and the Client for the provision of roofing services or goods. 

"Goods" refer to any materials or products supplied by the Company. 

"Services" refer to the roofing and related services provided by the Company.

 

  1. Acceptance of Terms

By engaging the Company for the provision of Goods or Services, the Client agrees to be bound by these Terms and Conditions. No variation of these terms shall be valid unless agreed in writing by both parties.

 

  1. Quotations and Estimates

All quotations provided by the Company are valid for a period of 30 days unless otherwise stated. 

Quotations are subject to a full site inspection. Any unforeseen issues or changes in scope after the site inspection may result in changes to the quoted price. 

Any verbal quotations are indicative only and non-binding until confirmed in writing by the Company.

 

  1. Payment Terms

A deposit of 50% is required upon acceptance of the quotation. 

The remaining balance shall be payable on completion unless agreed otherwise.

Payments must be made by [accepted payment methods]. Failure to pay within the stipulated time may result in interest being charged on overdue invoices at a rate of 8% per annum plus the Bank of England base rate, as allowed under the Late Payment of Commercial Debts (Interest) Act 1998.

 

  1. Cancellation

The Client may cancel the Contract by providing written notice at least 7 days before the scheduled commencement of work. 

In the event of cancellation within 7 days of the commencement date, the Company reserves the right to retain the deposit or charge the Client for any materials already ordered.

 

  1. Workmanship and Materials

All materials used by the Company will conform to the appropriate British Standards and/or manufacturer’s specifications. 

The Company guarantees its workmanship for a range of 1, 5, 15 and 30 years, subject to normal wear and tear and any other limitations as outlined in the Contract. 

This guarantee does not cover defects arising from external factors, such as weather conditions, lack of maintenance, or misuse by the Client.

 

  1. Access and Site Conditions

The Client is responsible for ensuring the Company has unobstructed access to the site during the agreed working hours. 

The Client must inform the Company of any hazards or restrictions on the site that may affect the performance of the Services.

 

  1. Health and Safety

The Company adheres to all health and safety regulations as per the **Health and Safety at Work Act 1974

The Company reserves the right to halt work if health and safety risks are identified that cannot be mitigated.

 

  1. Liability 

The Company will not be liable for any indirect, special, or consequential losses arising from the performance or non-performance of the Services. 

The Company’s total liability under or in connection with the Contract, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid for the Goods and Services.

 

  1. Force Majeure

The Company shall not be liable for any delay or

failure to carry out its obligations if such delay or failure is caused by circumstances beyond its reasonable control, including but not limited to extreme weather conditions, acts of God, strikes, or government regulations.

 

  1. Complaints and Dispute Resolution

Any complaints regarding the Services must be submitted in writing within 7 days of completion. 

In the event of a dispute, both parties agree to first attempt to resolve the matter amicably. If an agreement cannot be reached, the dispute will be referred to an independent mediator in accordance with UK law.

 

  1. Data Protection

The Company will handle all personal data in accordance with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR) Client information will only be used for the purposes of fulfilling the Contract and shall not be shared with third parties without the Client’s consent unless required by law.

 

  1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any disputes.

 

  1. Amendments

The Company reserves the right to amend these terms and conditions at any time. Any amendments will be communicated in writing and will apply to future Contracts.
